Acceptance of terms
(1) By participating in the OSAKAKUMA Christmas campaign ("Promotion"), you agree you are aged 18 or over, and you agree unconditionally and irrevocably to be bound by, and shall be deemed to accept, these terms ("Terms"') as provided by Kuma Retail Pte. Ltd. ("OSAKAKUMA", "we" or "us"'), in addition to the Terms of Use, the Terms & Conditions of Sale, the Vouchers Terms & Conditions, the Platform Engagement Tools Terms & Conditions, and OSAKAKUMA's Privacy Policy (collectively, "Terms of Use") for www.osakakuma.com website and/or the OSAKAKUMA physical stores, all of which are incorporated by reference into these Terms. Capitalised terms used and not defined herein shall have the same meaning as given to such terms in the Terms of Use.
(2) In the event of any inconsistency between these Terms and any brochures, marketing or promotional materials relating to the Promotion, these Terms shall prevail.
Eligibility
(3) To be eligible for the following Promotion, you must: Game of Chance

(d) be residing in Singapore;

Top Spender Reward
(a) have a registered membership account with OSAKAKUMA;

Participation Rules for Game of Chance
(4) The Promotion shall run from 1 December 2021, at 12:00 A.M. to 31 December 2021, at 11:59 P.M. (both dates and times inclusive) ("Promotion Period"). During this Promotion Period, you agree to participate in the Promotion ("Participant") by making any purchase (no minimum spend) on the OSAKAKUMA. There will only be 1 winner per grand prize and a total of 5 grand prizes to be won. The Winner will be contacted to claim their prize on the first week of January 2022. The Winner will also be announced on the OSAKAKUMA social media.
Participation Rules for Top Spender Reward
(5) The Promotion shall run from 1 December 2021, at 12:00 A.M. to 31 December 2021, at 11:59 P.M. (both dates and times inclusive) ("Promotion Period"). During this Promotion Period, you agree to participate in the Promotion ("Participant") by making any purchase (no
minimum spend) on the OSAKAKUMA. The Winner will be contacted on first week of January 2022. The Winner will also be announced on the OSAKAKUMA social media.
Selection and Announcement of Winner for E-Goal Keeper
(6) The Participant ("Winner") will be contacted via phone call on first week of January 2022. The Winner will also be announced on the OSAKAKUMA social media. Winner must be available to attend the prize presentation ceremony at a time and location to be confirmed, subject to prevailing Covid-19 regulations.
(7) OSAKAKUMA has the right to select another Winner after 3 unsuccessful attempts to contact the previously selected Winner within 24 hours. OSAKAKUMA is not obliged to provide any rationale or explanation and all decisions made in relation to this Promotion are at OSAKAKUMA's sole and absolute discretion. No correspondence will be entertained.
(8) In the event a Winner cancels, returns, or refunds the Purchase, even after the announcement has been made determining that they are the Winner, the Purchase shall be deemed void, and the Winner will have to forfeit the Prize. OSAKAKUMA reserves the right to then award the Prize to another Participant. For the avoidance of doubt, the Prize shall not be forfeited in the event the Purchase is cancelled (partially or in whole) by OSAKAKUMA.
(9) There is only one Prize to be won - a 4 Nights Ocean getaway cruise with Royal Caribbean worth SGD1500 (the "Prize") in a form of Chan Brothers voucher.
(10) Prize is subject to the standard terms and conditions of the prize, a norminated parent/guardian must accompany any person under 18 years of age. Itinerary to be determined by OSAKAKUMA in its absolute discretion. The winner (and their companions) must depart from and return to the same departure point and travel together.
(11) Each prize does not include shore excursions, transfers to or from the winner’s home to the place of departure, passports, vaccinations, other spending money, drinks, or other onboard cruise activities including spending money for the casino. No additional accommodation is included in the prize.
(12) Each winner and guests taking the prize must ensure that they have valid documentation, including but not limited to valid passports, prior to taking the prize. Any cost associated with obtaining valid documentation id the sole responsibility of a winner and guests.
(13) It is a traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports, which meet the requirements of immigration and other government authorities at any destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of the relevant authorities will be the sole responsibility of the travellers.
(14) Standard terms and conditions of travelling on Royal Caribbean will apply, including any applicable age restriction. Travel will be subject to the booking and passage conditions of the relevant brochure which must be signed by all travellers.
Personal Data
(15) By participating in the Promotion, you agree that OSAKAKUMA may collect, use, disclose and process personal data from you, which may include personal information such as photographs, name and username that you may upload, provide or use, email addresses for the purpose of sending you emails of latest promotion, and share them with third parties (including but not limited to, related companies, third party service providers or partners), in order to organise, promote, conduct or otherwise this Promotion. You may learn more about how we handle your personal data at https://osakakuma.com/pages/privacy-policy. Upon conclusion of the Promotion, you consent to OSAKAKUMA sharing your name, mobile number or email address with any related companies & business partners, in relation to their product and services including notification of events, promotion and future delivery of marketing information (via email, call or SMS). In the event you wish to withdraw your consent, kindly contact us at Customer Care customer@oskakauma.com.
(16) Further, if you are the Winner, you agree to:
(a) be contacted by OSAKAKUMA,
(b) be featured in all related marketing and promotional materials as notified by OSAKAKUMA.
(17) You agree to indemnify OSAKAKUMA from any loss, damage, fine, regulatory action, claim or compensation of whatever nature brought by any third party arising from your actions or omissions in the Promotion.
(18) OSAKAKUMA shall not be responsible to you for any loss, damage, fine, regulatory action claim or compensation of whatever nature arising from or related to Promotion ("Liabilities"). In the event that any Liabilities are not excluded by the foregoing sentence, OSAKAKUMA’s maximum aggregate liability to you in respect of such Liabilities, whether under all applicable laws of contract, tort or otherwise, shall to the fullest extent permitted by applicable law be SGD 50.
(19) Where OSAKAKUMA deems that a Participant has breached of any of these Terms and/or the Terms of Use, including fraudulently participating in the Promotion, OSAKAKUMA reserves the right, at their sole and absolute discretion, to prevent or restrict access of that Participant to the Platform. If Prize have been claimed, OSAKAKUMA also reserves the right to reclaim or seek compensation or restitution without any recourse from the Participant.
(20) A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these terms and conditions.
(21) OSAKAKUMA reserves the right to change these Terms at its sole discretion and without prior notice, and has the sole and absolute discretion to decide on all matters in relation to this Promotion. This includes but is not limited to the interpretation of these terms, eligibility of Participants, and any matter in relation to the Prize.
(22) Any clause in these Terms that are invalid, unenforceable or illegal shall be deemed severed and shall not affect the enforceability of any other clauses which shall continue to be valid and enforceable to the fullest extent permitted by law.
